瑕疵證據(jù)的可采性及其證明力

摘  要

瑕疵證據(jù)，是指民事訴訟當事人在收集證據(jù)時用的手段或是證據(jù)本身的表現(xiàn)形式有缺陷，導致證明能力下降的證據(jù)。瑕疵證據(jù)在我國現(xiàn)階段是必然產(chǎn)生的。但我國現(xiàn)階段對瑕疵證據(jù)的規(guī)定較少，也并不規(guī)范。所以，應對瑕疵證據(jù)的可采性做出1個判斷的標準：看訴訟當事人違反法律的程度和侵害他人合法權益的大小；是否有其他證據(jù)的補強；衡量各方面的利益對其是否可以采用做出判斷。并且對1些嚴重違反法律規(guī)定的或嚴重侵害他人合法權益的瑕疵證據(jù)予以排除。而且，其證明力只有在有其他證據(jù)對其補強后才能對事實的真相做出證明。

Abstract

    Flaw evidence refers to the evidence which causes proving ability to decrease because of the defects of collecting evidence or the defects of  its representation.  It comes into being inevitably during this period of our country. But now there is less stipulate of flaw evidence and the stipulate existed now is not normal. Thus there should be a standard about the receivability of flaw evidence: the extent to which the lawsuit part has violated law and invaded others legal rights and interests; is there any other makeup or strengthening; consider the interests of all aspects to judge the adoptability of the flaw evidence. And exclude some flaw evidence whieh violated law and invade others legal rights and interests seriously. what is more，the ability of evidence could be useful for the truth only after other added evidences work at same time。
