關(guān)于統(tǒng)一化構(gòu)建我國(guó)執(zhí)行體制的思考
摘 要
“執(zhí)行難”的成因是多方面的，但根本原因是在于執(zhí)行體制本身。我國(guó)現(xiàn)階段執(zhí)行體制的主要特征是執(zhí)行機(jī)構(gòu)的獨(dú)立性不夠，沒(méi)有單獨(dú)的《強(qiáng)制執(zhí)行法》。其主要原因在于沒(méi)有認(rèn)清執(zhí)行權(quán)的性質(zhì)。執(zhí)行權(quán)是1種綜合性的權(quán)力，所以執(zhí)行權(quán)也不能被審判權(quán)吸收，而應(yīng)該制定單獨(dú)的《強(qiáng)制執(zhí)行法》，設(shè)置類(lèi)似海關(guān)系統(tǒng)的垂直領(lǐng)導(dǎo)機(jī)構(gòu)即執(zhí)行法院，統(tǒng)1行使執(zhí)行權(quán)。

Abstract
There are many causes for the difficulty in law enforcement, but the most fundamental one lies in the system of law enforcement itself. In our country, the current enforcement system is mainly featured with the inadequate independance of law enforcement institutions, and there is no separate "law of compulsory enforcement". The main reason for this is because the nature of enforcement power is not clearly understood. The law enforcement power is a comprehensive power, thus should not be included in jurisdiction power, but be clearly divided from jurisdiction by formulating a separate "law of compulsory enforcement". And a vertical enforcement structure, similar to the structure of customs, must be set up, to exert exclusively the power of law enforcement.
