效率違約以及在中國的適用

摘    要

對(duì)于日常交易中碰到的合同問題，是單純從法律意義考慮合同的履行還是在法律基礎(chǔ)上再通過其他理論來調(diào)整合同的真正的社會(huì)效用，這就是現(xiàn)在越來越受關(guān)注的效率違約問題。效率違約就是指違約方從違約中獲得的利益大于他向非違約方作出履行的期待利益。文章試從效率違約的含義及其產(chǎn)生的理論依據(jù)出發(fā)，對(duì)效率違約的合理性及是否可以在中國合同法中對(duì)其進(jìn)行借鑒進(jìn)行1些探討。

ABSTRACT

For Contract issues occur in daily life， considered purely the performance of contract in legal way or use other theory to adjust the social utility of contract，that is the efficiency violation question which has received more and more attention. .The efficiency violation is refers to that the violation side obtained bigger benefits from violation than he shall get after performing the contract. This article basis from the meaning of efficiency violation and its source， carry on some discussions about its rationality and transplantability
